Rick,
There is no rocket science to folding up the 3rd seat. I never read the owners manual to learn how to do it. There is only one way to do it. So if your getting the lower half in place and pushed down with the back rest still moving, than there is a defect. I would definately get it resolved before letting a passager sit in it. As Al stated its a safty hazard.
