Sounds to me like you're not putting the seat bottom back in right.

The rear of it needs to go all the way "under" the seatback first, while holding the front of the bottom piece up at about a 45 angle, and then you push it down until it locks in place. If you don't lift up on the front of the bottom and push it back under the seatback it won't properly sit under the back before you push it down allowing the seatback to move which is unsafe.
